1 – Contract Conclusion

Any order for products implies full and unconditional acceptance of these general terms and conditions of sale, supplemented or amended by our special conditions, which override any contradictory clause that may appear in purchase conditions, order forms, or other commercial documents.

2 – Prices

Goods are invoiced at the rate in force on the day the order is placed. Prices may be revised subject to prior notice of 30 days.

3 – Delivery

Delivery is carried out either by direct handover of the product to the buyer, by notice of availability, or by delivery to a shipper or carrier at the seller’s premises or any other designated location.

The buyer must check the goods at the time of collection. In the event of damage, shortage, visible defects, or non-compliance of the delivered product, the buyer must issue clear and precise reservations, notified in writing to the seller or the carrier within three days following delivery. It is the buyer’s responsibility to provide proof of the anomalies observed.

4 – Delivery Times

Delivery times are provided based on supply availability. Except in cases of force majeure (war, pandemic, riot, fire, total or partial strike, etc.), if delivery is delayed by more than 20 days after the indicative delivery date, the buyer may cancel the order without being entitled to any compensation.

5 – Returns

If, despite our best efforts, you are not satisfied with your purchase, in accordance with Article L.121-20 of the French Consumer Code, you have a period of 15 full days from the date of receipt to return the products ordered for a refund.

Return costs are borne by the customer (except in exceptional cases where an item is defective or an error has been made in the order). Your refund will be processed within a maximum of 15 days from receipt of your return.

6 – Warranty

The seller will take the greatest care in fulfilling the order and in the quality of the products. In the event of a defect recognized by the seller, the seller’s obligation is limited to the replacement or refund of the defective quantities, without any other compensation.

The warranty excludes defects and damage resulting from abnormal storage, handling, transport, or use not in conformity with the nature, specifications, or intended purpose of the product.

7 – Payment

Unless otherwise specified, invoices are payable upon ordering. In the event of late payment, the seller may suspend all current orders.

Any amount not paid by the due date stated on the invoice will automatically incur penalties equal to one and a half times the legal interest rate. These penalties shall be payable upon simple request by the seller. No discount is granted for advance payment.

8 – Termination Clause

In the event of non-payment, and 48 hours after a formal notice remains unsuccessful, the sale will be automatically terminated by the seller, who may request the return of the products through summary proceedings, without prejudice to any other damages and interests.

Amounts remaining due for other deliveries shall become immediately payable if the seller does not opt to terminate the corresponding orders.

9 – Retention of Title

Goods sold remain the property of the seller until full payment of their price. However, the risks associated with the goods are transferred to the buyer or the carrier upon physical handover of the products.

10 – Jurisdiction

These conditions cancel and replace any previously applicable conditions.
Any dispute relating to these terms shall fall under the jurisdiction of the Commercial Court of Perpignan, France.
